Payroll and employer compliance means paying people correctly and then reporting and depositing the taxes on time with the IRS, the Illinois Department of Revenue (IDOR) and the Illinois Department of Employment Security (IDES). Mistakes here are costly because payroll taxes are held in trust for the government. Our firm sets up and supports payroll for Illinois employers, and for businesses that employ people in Canada or India we coordinate with your Canadian CPA or Indian CA so payroll records and filings agree.
Who needs payroll and employer compliance help?
- First-time employers in Aurora, Batavia and Naperville hiring their first employee.
- Restaurants, clinics and contractors with many hourly workers.
- S corporation owners who must pay themselves wages.
- Companies sponsoring H-1B or TN workers, or hiring remote staff in another country or state.
- Employers with a late filing, a deposit penalty notice or a payroll tax balance.
What a compliant payroll includes
- Registrations. An EIN from the IRS (free, direct from the IRS), an IDOR withholding account through MyTax Illinois, and an IDES employer account. IDES says every business with employees in Illinois must register, and contributions are generally due once an employer has paid $1,500 in wages in a calendar quarter or meets other tests.
- Employee forms. Form W-4 for withholding, Form I-9 for work eligibility and, for contractors, Form W-9.
- Each payroll. Gross-to-net calculations, federal and Illinois withholding, employee and employer payroll taxes, and benefits deductions.
- Deposits. Federal tax deposits and Illinois withholding payments.
- Quarterly and annual returns. Forms 941 and 940, Illinois quarterly returns, and year-end forms.
Key rates, dates and rules
| Item | Rule |
|---|---|
| Social Security | 6.2% employee plus 6.2% employer, up to the 2026 wage base of $184,500 |
| Medicare | 1.45% employee plus 1.45% employer, with no wage cap; an additional 0.9% employee tax applies above income thresholds such as $200,000 for single filers |
| FUTA | 6.0% on the first $7,000 per employee, reduced by up to 5.4% credit to 0.6% when state tax is paid |
| Monthly depositor | Deposit by the 15th of the following month |
| Semiweekly depositor | Wednesday, Thursday or Friday paydays by the following Wednesday; Saturday through Tuesday paydays by the following Friday |
| $100,000 rule | Deposit by the next business day when taxes reach $100,000 on any day |

| Form 940, W-2, W-3, 1099-NEC | January 31, 2027 for the 2026 year |
The IRS gives employers 10 extra days to file Form 941 or Form 940 when every deposit was made on time. Weekends and holidays move due dates to the next business day. Our U.S. employer compliance checklist and Illinois payroll guide explain each step, and the employer registrations guide covers local setup.
Employees in Canada or India
| Country | Typical payroll obligations | Who handles them |
|---|---|---|
| United States | Withholding, FICA, FUTA, Illinois withholding and unemployment contributions | Our firm |
| Canada | CRA payroll account, CPP (5.95% in 2026), EI (1.63% in 2026), remittances by the 15th of the next month for regular remitters, T4 slips due the last day of February | Your Canadian CPA, coordinated by us |
| India | Employee provident fund (12% employee plus 12% employer under the EPF scheme), income-tax deduction at source and other labour compliance | Your Indian CA, coordinated by us |
Foreign workers on a U.S. payroll can also raise Social Security questions. The IRS says an agreement between countries can prevent double social security tax, and a person claiming an exemption must generally present a Certificate of Coverage from the home country. See payroll and social security compared and hiring U.S. employees from abroad.
How the engagement works
- Consultation. We review your headcount, pay frequency, states, benefits and visa-sponsored staff.
- Written engagement agreement. It sets the payroll scope, the filings included and the fee basis, and you sign it before we start.
- Document checklist. We list the registrations, employee forms and prior payroll reports we need.
- Preparation. We set up the payroll, test the first run and map deposit schedules.
- Review. You approve each payroll register before payments are released.
- Filing. We prepare deposits, quarterly returns and the year-end W-2 and 1099 packages.
- Follow-up. We reconcile payroll to your books each quarter and handle notices.
Documents to prepare
- EIN confirmation letter and any IDOR and IDES account numbers.
- Employee list with legal names, addresses, start dates, pay rates and withholding forms.
- Completed Forms I-9 with supporting documents kept on file.
- Prior payroll reports, deposit confirmations and Forms 941 for the current year.
- Contractor list with Forms W-9 and amounts paid.
- Benefit plan details such as health premiums and retirement deferrals.
Common situations and fixes
- Contractor or employee. The label is not decisive; we apply the IRS and Illinois factors and discuss the risks of reclassifying.
- Late or missed deposits. We reconcile what was withheld, calculate the correct deposits and discuss penalty relief where eligible; see IRS and state tax representation.
- Out-of-state remote worker. A remote employee may create withholding and unemployment duties in another state.
- Owner-employees. S corporation shareholders who work in the business need payroll with reasonable pay.
- Wrong IDES or IDOR setup. We correct the account type and start date.
A worked example
An Aurora dental office has eight employees and gross wages of $40,000 a month, all below the wage base. Employee Social Security and Medicare tax is 7.65% or $3,060, matched by $3,060 from the employer, a combined $6,120 per month. Add $4,800 of federal income tax withheld and the monthly deposit is $10,920, due by the 15th of the next month for a monthly depositor. We also file Form 941 each quarter, send W-2s by January 31 and handle the IDES quarterly report. A new hire is added with a W-4, an I-9 and a new-hire report.

Frequently asked questions
When do I register as an employer in Illinois?
Before your first payroll. Register with the IRS for an EIN, with IDOR for withholding and with IDES for unemployment insurance.
How do I know if I am a monthly or semiweekly depositor?
It depends on your tax liability in a lookback period, which we confirm from your prior reports. New employers generally start as monthly depositors.
What is the Social Security wage base for 2026?
$184,500, according to IRS Publication 15. Wages above that amount are not subject to the 6.2% Social Security tax but remain subject to Medicare tax.
Can you run payroll for my employees in Canada or India?
No. Your Canadian CPA and Indian CA handle payroll compliance under Canadian and Indian law. We keep the U.S. payroll and your records consistent with theirs.
What if I missed a payroll deposit?
Act quickly: calculate the correct amount, make the deposit and discuss penalty relief with us. The IRS offers relief in some situations, but we cannot promise it.
