The 1099-K threshold in the United States is gross payments above $20,000 and more than 200 transactions, as of October 2026, but gig and online-platform income is taxable with or without a form. Canada taxes platform income and has operators report sellers to the CRA, and India deducts TDS on e-commerce payouts.
How do platform income rules compare?
| Question | United States (tax year 2025) | Canada (2025 tax year) | India (tax year 2026-27 rules) |
|---|---|---|---|
| Who reports | Platform files 1099-K above $20,000 and 200 transactions | Operator reports to the CRA; small sellers excluded | Operator deducts TDS on payouts |
| What you receive | Form 1099-K | A copy of the operator's report | TDS credit in Form 26AS and AIS |
| Where you report | Schedule C | Form T2125 | ITR-3 or ITR-4 for business income |
What is the 1099-K threshold in the United States?
As of October 2026 a payment app or marketplace files Form 1099-K only above $20,000 and more than 200 transactions; both tests must be met. The 2021 American Rescue Plan Act set $600. The IRS kept $20,000 and 200 for 2023 and planned $5,000, $2,500 and $600 for 2024 to 2026 (Notice 2024-85), but the 2025 law reversed that retroactively.
- Forms 1099-NEC and 1099-MISC: $2,000 for payments after December 31, 2025 (it was $600).
- A form can still arrive below the threshold. Illinois payers file with the state at four or more transactions totaling over $1,000.
To handle it as a freelancer or seller:
- Total gross payouts, fees and refunds by platform and compare with any 1099-K.
- Report business sales on Schedule C. Self-employment tax is 92.35% of net profit times 15.3%. You must file once net self-employment earnings reach $400.
- Report personal items sold at a gain on Form 8949 and Schedule D. Losses are not deductible, so enter the combined 1099-K amount in the entry space at the top of Schedule 1.
- Pay estimated tax on April 15, June 15 and September 15, 2026 and January 15, 2027 (see the federal tax calendar).
Canada: what applies to platform and gig income?
- Report everything: sharing, gig, peer-to-peer and influencer income, including tips and gifts, on T2125 (lines 13499 and 13500); rental on T776. See the T2125 guide.
- Operator reporting: under Part XX, platforms report sellers to the CRA from the 2024 calendar year, by January 31, and sellers get a copy. Sellers with fewer than 30 goods sales totaling $2,800 or less are excluded.
- No slip to wait for: no CRA page we read says platforms issue a T4A. T5018 is a construction slip.
- GST/HST: ridesharing registers from the first dollar; accommodation sharing above $30,000 over four calendar quarters. See GST/HST registration.
- Dates: 2025 returns were due April 30, 2026, or June 15 if you or your spouse is self-employed, with payment still due April 30.
India: what applies to online sellers?
- E-commerce TDS: 0.1% of gross sales (Income-tax Act, 2025, tax year 2026-27); none for an individual or HUF seller with PAN or Aadhaar and gross sales of Rs 5 lakh or less. Confirm the FY 2025-26 rate with your Chartered Accountant.
- Business benefits: 10% TDS above Rs 20,000 a year.
- GST: thresholds depend on goods or services and the state, so none are stated here. See GST in India.
- Filing: check Form 26AS and AIS, keep PAN and Aadhaar current, and use ITR-3 or ITR-4 for business income. FY 2025-26 returns were due August 31, 2026 for non-audit business income (July 31 without it), or as belated returns by December 31, 2026, with a fee.
Worked example
These figures are invented for illustration. Dana in Batavia sold crafts on a marketplace in 2025: $18,500 over 240 transactions, so no 1099-K is required, but her $12,000 net profit goes on Schedule C, with self-employment tax of about $1,696 (half, $848, is an income adjustment). Her cousin in Calgary drives for a ridesharing platform and registers for GST/HST from his first dollar. Her uncle in Pune has gross sales of Rs 12 lakh, so the operator deducts 0.1%, about Rs 1,200, which he checks in Form 26AS.
Mistakes and cross-border traps
- Quoting $600, or assuming no form means no tax.
- India: credit in the return is limited to Form 26AS, so ask the deductor to correct a TDS mismatch.
- A US citizen freelancing from Pune or Calgary reports platform income on the US return and the local return; see foreign tax credits.
- India: a resident with a foreign account must file even with low income.
What we do
We handle the US side: Schedule C, self-employment and estimated tax, and matching 1099-K records. We coordinate with your Canadian CPA and Indian Chartered Accountant, who prepare the T2125, GST/HST, ITR and GST filings, so the three agree. See business tax returns and planning and more tax questions.
Frequently asked questions
Do I report income if I get no 1099-K?
Yes. Income is taxable with or without a form.
Does a friend's payment count as income?
Gifts and reimbursements from friends are not income. Payment for goods or services is.
Does a Canadian platform send a T4A?
No CRA page we read says so. Report from your own records.
Is TDS always deducted from Indian marketplace payouts?
No. It is not deducted for an individual seller with PAN or Aadhaar and gross sales of Rs 5 lakh or less.
