Elgin, IL Business License, Occupancy Permit and Local Tax Guide

Elgin IL business license and occupancy permit steps, the $200 application, rental licenses, city taxes and Kane and Cook County property tax notes for owners.

Updated October 23, 2026 · 6 min read

In Elgin, one application starts two approvals: the city's Business Application serves as both your occupancy permit and your general Elgin IL business license. The process is more structured than in most Fox Valley towns, and Elgin also adds a food sanitation program run by its own Environmental Health Division, a rental license with inspections and an address that can sit in either Kane or Cook County. This guide follows the order of the city's own process and then covers local taxes, rental rules and the county overlay.

Which county, township and ZIP codes cover Elgin?

Elgin lies in both Kane County and Cook County, and each side has its own entry in the state's tax rate file. The Census Bureau's ZIP Code Tabulation Areas overlapping the city are:

ZIP codeApproximate share of city land area
60123about 35%
60124about 30%
60120about 26%
60140about 7% (a Hampshire ZIP)
60175about 2% (a St. Charles ZIP)

Kane County parcels are assessed by township assessors; the county assessments office reported that Elgin Township's 2026 assessment changes were published on October 2, 2026, with a final filing date of November 2, 2026. See the Kane County guide for the appeal steps. Cook County parcels follow the Treasurer and Assessor schedules in the Cook County guide.

How do you get an Elgin IL business license and occupancy permit?

  1. Zoning inquiry. Complete the Zoning Inquiry Form and send it to Community Development. You will learn whether the use is allowed, conditionally allowed (a Conditional Use process with a public hearing and extra fees) or not allowed at that address.
  2. Business Application. Fill it out, print it and bring it to Community Development with supporting documents and the $200 fee. It is meant for owners opening, expanding, relocating, changing services or changing ownership.
  3. Wait for the response. Staff reply within 7 to 10 business days with additional permits needed, estimated fees and a timeline.
  4. Inspections. Each permit needs at least one inspection; inspections carry no fee, but re-inspection fees can apply after more than three re-inspections.
  5. Certificate of Occupancy and Business License are issued when inspections pass.
  6. Special licenses, such as a food establishment license or liquor license, keep their own annual fees.
  7. Report changes to the city for any change in contact, services, ownership or relocation.

The city recommends speaking with staff before any purchase or lease, and an online portal to track applications is being built. Compare the local licenses, permits and zoning guide.

Who inspects restaurants in Elgin?

Elgin licenses and inspects food establishments through its own Environmental Health Division, using the FDA Food Code and a risk-based inspection approach, with separate pages for plan review, temporary and seasonal food handling, cottage foods and licensed food handling establishments. That means a restaurant inside Elgin should confirm with the city, rather than assuming it needs the Kane County Health Department permit described in the Kane County guide.

What are Elgin's rental license rules?

Anyone operating or offering residential rental property in Elgin needs a rental license, and it is unlawful to occupy an unlicensed rental. Licenses are not transferable on sale: a new owner has 30 days from closing to apply. A new license lasts one year, extended to three after a clean inspection and landlord training. In multi-unit buildings inspectors review the exterior, common areas, basements and 20% of dwelling units; in single-family rentals they inspect the whole home.

What local taxes does Elgin impose?

The city lists three local taxes on its payment page: a motor fuel tax, a hotel or motel room rental tax and an alcoholic liquor tax, each with online forms. We could not confirm the current rates from the page, so check the forms before registering. Elgin also requires a real estate transfer stamp before any conveyance inside the city; contact Finance three to five days before closing so the city can run its code violation search and check seller debts, including the final water bill.

A worked example

Carlos buys a four-unit building on the Kane side of Elgin. His seller obtains the transfer stamp before closing, and Carlos acknowledges the city's code violation search. Within 30 days of closing he applies for a new rental license and prepares for the inspection. When he opens a small bakery on the ground floor he files one Business Application at $200, and the city replies with the permits and food license it will need. For his rental income, see our real estate investor tax service.

What help is available?

The city's business resources page lists the Elgin Area Chamber of Commerce, the Elgin Development Group, the Downtown Neighborhood Association, Fox Valley SCORE, the Gail Borden Public Library, the Northwest Hispanic Chamber of Commerce and the Women's Business Development Center. The Illinois SBDC network lists Waubonsee Community College and Harper College among nearby centers; see the small business resources guide.

Elgin families with income in India or Canada

A household with income or property in India or Canada has three sets of rules to coordinate. Start with the foreign account reporting guide, the three-country family tax planning guide and the USA, India, Canada and cross-border hubs. We prepare the U.S. side and share information with your Canadian CPA or Indian Chartered Accountant so the three filings agree.

Mistakes to avoid

  • Signing a lease before the zoning inquiry is answered.
  • Missing the February 1 license date.
  • Assuming a purchased rental keeps the seller's license.
  • Using the wrong county's tax and permit rules for a split-county city.
