India new 52-week highs are the NSE and BSE securities whose price has just traded above everything seen in about the past year. In India a rally is shaped by rules that other markets lack: exchanges can fix daily price bands, and surveillance frameworks can freeze the upper side of trading in stocks whose prices look out of line with their fundamentals. This page explains those mechanics, then covers how a gain on such a holding is taxed under the Income-tax Act, 2025 and what changes for an NRI or a U.S. or Canadian taxpayer.
What are India new 52-week highs?
Each row is a security whose latest price exceeded its highest price of the previous 52 weeks. Stocks and ETFs are mixed; the name or fund description tells them apart. Data is delayed, and a provider may adjust old prices for splits and bonus issues differently from your broker. Column definitions are on the India most active page.

How price bands limit a rally
| Control | What it does |
|---|---|
| Individual price bands | SEBI's master circular describes bands of up to 20% either way for scrips in rolling settlement, except those with derivatives |
| Dynamic price bands | For stocks with derivatives, the band is 10% of the previous day's close, orders beyond it are not accepted, and it is relaxed in steps of 5% after cooling-off periods when a price keeps trending |
| Index circuit breakers | A 10%, 15% or 20% move in the Nifty 50 or Sensex halts the market, as explained on the India most active page |
| Surveillance measures | NSE's Graded Surveillance Measure targets securities whose prices are not commensurate with earnings, book value, net worth or similar fundamentals |
NSE says securities placed under surveillance may be moved to the trade-for-trade category, require an additional surveillance deposit, trade once a week or have their price frozen on the upper side. Constituents of the Nifty 500 or BSE 500 and shares listed through an IPO in the last year are excluded from GSM shortlisting. A stock at a 52-week high that is also under a surveillance stage is a different situation from a large-cap at a high, and the exchange's lists show which is which.
What a new high does not tell you
- Whether the move is sustainable. Highs can reverse the next day.
- Whether the volume was real. Check the India unusual volume page for surges that deserve a closer look.
- What you earned. Your gain depends on your cost, dates and the 2018 rule below.
How is the gain taxed?
The Income-tax Act, 2025, in force from April 1, 2026, sets out the rules your Chartered Accountant (CA) applies.
| Item | Rule in the Act |
|---|---|
| Short-term line | Securities listed on an Indian exchange: not more than 12 months. Other assets: not more than 24 months |
| Short-term gain on listed equity | 20% if securities transaction tax was payable on the sale |
| Long-term gain on listed equity | 12.5% on long-term gains exceeding Rs 1,25,000, if tax was paid on acquisition and transfer (for shares) |
| Shares acquired before February 1, 2018 | Cost is the higher of the actual cost and the lower of the January 31, 2018 market price and the sale price |
Hypothetical example: a resident buys 2,000 shares of Example Corp at Rs 300 each in 2019 and sells at Rs 480 in November 2026, a gain of Rs 3,60,000. Assume the 2018 rule does not change the cost. The first Rs 1,25,000 is outside the 12.5% rate, leaving Rs 2,35,000 taxed at 12.5%, or Rs 29,375, before surcharge and cess. Your CA confirms the figures.
NRIs face the same listed-equity rates; tax is commonly deducted at source and any excess is recovered by filing a return. See capital gains for NRIs.
One list, three readers
| Reader | Cross-border point |
|---|---|
| Indian resident | Report in the Indian return; compare with the other markets in capital gains compared |
| U.S. citizen or resident | The gain is also reportable in dollars on the U.S. return, using dollar cost and proceeds, so the currency effect changes the figure; a foreign tax credit can relieve double tax. See foreign tax credits across three countries and the U.S.-India treaty |
| Canadian resident | The sale is reported in Canadian dollars and half the gain is taxable; Indian holdings may need a T1135 |

Frequently asked questions
What does upper circuit mean?
It means the price has reached the top of the band the exchange has set for the day, so buy orders above that price are not accepted.
Does a 52-week high make my gain taxable?
No. Tax arises when you sell.
Do I pay India's 12.5% rate on all gains?
Only on long-term gains exceeding Rs 1,25,000 a year on listed equity where securities transaction tax was paid. Other assets follow other rules.
Is the 2018 cost rule automatic?
The Act applies it to shares acquired before February 1, 2018. Your broker and CA must check your cost records.
Can a U.S. person claim a credit for Indian tax on the same gain?
Often, within limits. See our U.S.-India treaty guide and talk to a CPA.
