The India income tax act 2025, formally the Income-tax Act, 2025, replaced the Income-tax Act, 1961 on April 1, 2026. It rewrites the law's language and structure while, according to the government, leaving tax policy and rates alone. If you are an NRI, a returning resident or a U.S. or Canadian resident with Indian income, the practical question is which Act governs which return.
What changed in the India income tax act 2025?
The Press Information Bureau (PIB) describes the reform as simplification without new tax policy:
- Plainer structure. Fewer sections and chapters, with tables and formulae in schedules, and obsolete provisions removed.
- One period label. A "tax year" is the twelve-month financial year starting April 1, so the old two-year puzzle of previous year and assessment year disappears for new periods.
- Consolidated TDS rules. Provisions on tax deducted at source that were scattered across the 1961 Act were gathered into a single section (section 393 in the new Act, per PIB).
- Digital assets and enforcement. Virtual digital assets are defined more broadly, and "virtual digital space" (email, cloud accounts, trading accounts) is defined for search and survey purposes.
- New Rules and forms. The Income-tax Rules, 2026 came with a new set of forms, and the e-Filing portal has been adding utilities since.
Which Act applies to your return?
| Situation | Governing law | Example |
|---|---|---|
| Income earned April 2025 to March 2026 | Income-tax Act, 1961 | Return for AY 2026-27 filed in 2026 |
| Income earned from April 2026 | Income-tax Act, 2025 | Tax year 2026-27 return, filed in 2027 |
| Dues for periods up to FY 2025-26 | Income-tax Act, 1961 | Paid through the portal's integrated payment module |
| Payments for tax year 2026-27 onward | Income-tax Act, 2025 | Advance tax for the current year |
The CBDT's Circular 07/2026 of September 28, 2026 shows both Acts operating at once: it acts under section 119 of the 1961 Act read with section 536 of the 2025 Act to move audit-case dates for assessment year 2026-27. Our Act 2025 transition guide walks through the overlap.
What does it mean for NRIs and cross-border families?
- Residency. PIB says the Act does not alter underlying tax policy, so residence is still decided by day-count tests. Your CA confirms the rules for each year; see residency, NRI and RNOR status.
- Filing. NRIs with Indian income file the return forms notified for AY 2026-27 on April 8, 2026; see the NRI ITR step-by-step.
- Foreign assets. Since July 20, 2026, taxpayers can see CRS and FATCA foreign asset information in their Annual Information Statement, so reconcile it before you complete Schedule FA.
- Disclosure scheme. Notification 114/2026 (September 1, 2026) set rules for the Foreign Assets of Small Taxpayers Disclosure Scheme, 2026. Ask your CA whether it fits your facts and what its closing date is before you act.
- Treaties and credits. Form 10F, tax residency certificates and foreign tax credit claims remain part of the toolkit; see treaty documents.
What should you do now?
- Ask your CA which Act and form apply to each return and payment this year.
- Label documents clearly as financial year, assessment year or tax year.
- Review your AIS for bank, interest and foreign asset entries via the portal, AIS and Form 26AS guide.
- Diary the dates on the India compliance calendar.

Frequently asked questions
Does the Income-tax Act, 2025 change my tax rate?
PIB states that the reform did not modify tax rates or major policy. Rates for any year still come from that year's Finance Act, so check with your CA.
Do NRIs file under the new Act this year?
Not for income earned up to March 31, 2026. That income is reported for assessment year 2026-27 under the 1961 Act. The first returns under the new Act cover tax year 2026-27.
Are section numbers the same as before?
No. The new Act renumbers and consolidates provisions, so a reference to a 1961 Act section may not match the new Act. Always name the Act when you cite a section.
Where should I verify current rules?
Use the Income Tax Department's e-Filing portal and incometaxindia.gov.in, and ask your CA. They post circulars, forms and notifications.
