Payroll Filing Compliance Compared: U.S. and Illinois, Canada and India Deposits, Returns and Year-End Slips

Payroll filing compliance compared: U.S. Form 941 and W-2, Illinois IL-941, Canada's remittances and T4, and the cycle for India's TDS and social security.

Updated October 23, 2026 · 7 min read

Payroll filing compliance compared across borders comes down to the same three tasks in every country: withhold tax and social contributions from pay, deposit them on a schedule, and report them in periodic returns and an annual statement for each employee. The schedules differ enough to trip up an owner who runs payroll in more than one country, such as an Aurora business with a Mississauga subsidiary or an Indian sister company. This guide compares the U.S. federal and Illinois cycles with Canada's and outlines India's, with the dates that fall in the next six months.

What are the United States and Illinois rules?

Federal. Employers deposit Social Security, Medicare and withheld income tax on a monthly or semiweekly schedule and report them on Form 941 each quarter. If liability for a quarter is under $2,500, you can pay with the return. FUTA tax is deposited when it exceeds $500 and reported on Form 940. W-2s and W-3 are due January 31; for 2026 wages that date is a Sunday, so the due date is Monday, February 1, 2027. The failure-to-deposit penalty is 2% for 1 to 5 days late, 5% for 6 to 15 days, 10% for more than 15 days, and 15% after a notice; the penalties do not add together.

Illinois. Illinois withholding uses a flat 4.95% rate and is reported on Form IL-941, filed electronically each quarter. New taxpayers start on monthly payments (15th of the next month) and quarterly returns; semiweekly payers pay by Wednesday and Friday. IDOR's Publication 131-D shows the 2026 dates, including IL-941 for Q3 due Monday, November 2, 2026 and Q4 due Monday, February 1, 2027, and monthly payments of November 16, December 15 and January 15, 2027. IDES wants quarterly wage reports by April 30, July 31, October 31 and January 31, and monthly reports from employers with 25 or more employees. See Illinois employer registrations and the Illinois payroll guide.

What are the Canadian rules?

The CRA assigns a remitter type from your average monthly withholding amount (AMWA) two calendar years earlier, reviewed each November.

Remitter typeWhen you remit
Quarterly (new small employers and small employers with a perfect compliance record)April 15, July 15, October 15, January 15
Regular (AMWA up to $24,999.99)Monthly, by the 15th of the next month
Accelerated threshold 1 ($25,000 to $99,999.99)By the 25th of the same month (for the 1st to 15th) and the 10th of the next month (for the 16th to month-end)
Accelerated threshold 2 ($100,000 or more)Up to four times a month, the third working day after the 7th, 14th, 21st and month-end

If you remit late, the CRA charges 3% for 1 to 3 days late, 5% for 4 or 5 days, 7% for 6 or 7 days, 10% for more than 7 days or if nothing is remitted, and 20% for a repeat knowing or grossly negligent failure in the same year, plus daily compounded interest. A payment due on a Sunday is on time if the CRA receives it the next business day, so November 15, 2026 becomes Monday, November 16. T4 returns are due the last day of February after the year, and if that day is a weekend the filing is on time the next business day: for 2026 slips, Monday, March 1, 2027. See Canada payroll source deductions and T4.

What does India require?

Employers in India deduct income tax at source from salaries and deposit it with the government, file periodic TDS statements, and give each employee an annual certificate. They also run provident fund and insurance contributions. Two legal changes make older dates unreliable: the Income-tax Act, 2025 replaces the 1961 Act for tax years beginning April 1, 2026 (see our India Income-tax Act 2025 transition guide), and the Code on Social Security, 2020 has taken effect in stages, with most provisions commencing on November 21, 2025 according to India Code. Some states also levy professional tax on salaries, and the labour codes affect wages and gratuity. We do not quote Indian deposit dates here because they depend on the current rules and the employer's category. Use India TDS and TCS for businesses and India labour and professional tax compliance and confirm dates with your Chartered Accountant or payroll provider.

What documents and steps does multi-country payroll need?

  1. Register in each country before the first paycheck: EIN and state accounts; CRA payroll account; TAN and provident fund numbers.
  2. Pick a payroll provider per country who files under local law.
  3. Gather employee data: U.S. W-4 and I-9; Canadian TD1 forms and SIN; Indian PAN, Aadhaar and bank details.
  4. Map the cycle: pay date, deposit date, quarterly return, annual slip.
  5. Check cross-border workers for dual coverage under the Social Security agreements; see payroll and social security compared.
  6. Reconcile at year-end: wages per payroll register, per deposit records and per returns.

Worked example

Fox Valley Design (Aurora) pays $6,000 a month to a U.S. employee and CAD 5,000 a month to a Mississauga contractor-turned-employee of its Canadian subsidiary. For the U.S. employee, the company deposits monthly: November 16, 2026 for October wages, then December 15 and January 15. It files IL-941 and Form 941 for Q3 by November 2, 2026, and for Q4 by February 1, 2027, along with W-2s. For the Canadian employee, a small regular remitter pays by the 15th of each month, and the T4 is filed by March 1, 2027. If the U.S. deposit were five days late, the failure-to-deposit penalty would be 2% of the unpaid deposit. If the Canadian remittance were five days late, the CRA penalty would be 5%.

Mistakes to avoid

  • Applying the U.S. 15th-of-month rule to the Canadian accelerated remitter schedules.
  • Forgetting that Illinois requires its own return and a separate unemployment account.
  • Assuming every agency treats a weekend due date the same way; IDES lists fixed dates, while the IRS, IDOR and CRA move the date to the next business day.
  • Using a prior-year Illinois IL-941 form.
  • Quoting Indian dates from older articles without checking the current Act and rules.

When are T4 slips due in Canada?

Rates and due dates are set by the Act, rules and notifications that can change; the new tax Act and labour codes have updated several rules, so confirm with your Indian adviser.
