Income of individuals, companies, trusts and pass-through businesses is taxed by the state under the Illinois Income Tax Act (35 ILCS 5). The Illinois Department of Revenue (IDOR) enforces it. This page is for owners in Canada, India or another state who hold a business with Illinois activity.

Slide show: The Illinois income tax in seven slides

  1. What it is

IDOR runs this state income tax. It starts from federal income and adds Illinois rules.

  2. Who it reaches

Residents, nonresidents with Illinois-source income, and businesses.

  3. The rule

Pass-through entities pay 1.5% replacement tax; owners pay on a share. An entity can elect to pay 4.95% for its owners.

  4. The numbers

In 2026 the individual rate is 4.95%, and C corporations pay 7% plus 2.5%.

  5. The dates

    Next: IL-941 for Q3 on 2 November 2026, individual estimates on 15 January 2027, IL-941 for Q4 on 1 February 2027.

  6. The penalty

A 2% penalty applies to payments 1 to 30 days late, and 10% to later ones. Interest is 7% simple through 31 December 2026.

  7. The tip

Track each owner's residency by month before the entity files. The Meridian Owner Roll-Call on page two shows how.
